Terms of Service for Physical Items help?

Hi everyone!

Last year I made a post about my Terms of Service for Art Commissions, and you were all so helpful with that - I'd like to thank you all for all the tips and ideas! Recently I've had a few ideas for customized physical items for people to commission (dolls remade to look like their OC's etc.), but as I haven't bought many items like this in the past, I haven't read very many TOS's dealing with this type of commission (like I have by reading artists' TOS's). I was wondering if any of you had any tips on writing Terms Of Service for physical customized goods, or any tips? I know it can be quite different because it's more difficult to make changes with physical items.

Not a TOS thing, but advice for later on: always, no matter the value, get a tracking number. It'll save you from most charge-backs from unscrupulous buyers as it proves it was sent and delivered.

GW's art is gorgeous but there are several policies in her rules I would advise against using as a basis for your own TOS.
(i.e. the asshole clause and the rule about only issuing partial refunds if the artist decides to cancel).

Asshole Clause: (the Artist calls it this, I am not name calling)

Most commissioners I work with are very patient, understanding, and polite with me, but every now and then someone is belligerent, rude, overly demanding, and in short, an asshole. If you are disrespectful to me, threatening, belligerent, or otherwise mean and nasty your commission will be cancelled and NO refund will be issued to you. You will also be blacklisted for any further commissions or business with me. If you have a problem you need to discuss it with me -in private- and in a civil manner. There is no need to be an asshole.

True. I understand that harassment is usually seen as a way to have your commission cancelled, but maybe not worded that way!

You may want to ask people to make sure they can receive your dolls in their country and tell them they're responsible for dealing with customs. I know of one doll maker who has had trouble with shipping because her items were on a prohibited list (http://pheleon.jlauportfolio.com/faq.html).

"I'd like to say that I ship everywhere, but if your country has a ban on plushtoys or textiles, there isn't much I can do about that!"

That's true, thank you! Dolls aren't really considered when you think of shipping things, so checking that first would be something most usually wouldn't do!

I would deffs add something to mention shipping times are NOT your responsibility and theres nothing you can do about wait times and quotes on delivery are just that, quotes.

Ive ordered stuff thats says 2 week delivery and its taken 6 weeks regularly.

I would add that anything with a deadline (birthday, con, and so on) needs to be shipped out a month and a half/6 weeks before the date, so probably 2-3 month order before the date.
