WHAT: Joint Auction we were co-hosting together with the intent payment be split 50/50 and work be split 50/50. Sadly the original auction post has been deleted. (2 Sketches, 2 Inked Pieces, 4 Full Color Pieces. I upgraded both sketches to inked due to the wait and my taking on all the work.)
WHEN: April 2012 to present.
PROOF: Original auction poster; I also have payment information (both full amount from commissioner and half amount I sent to Momo) if needed from paypal. The original auction post has been deleted. Ii-nkwell now goes by orange.pekoe on FA most recently.
This beware explains the entire situation, but is namely about Momo's lack of communication, aggressive attitude, account jumping to avoid me/others, and questions on pursuing a refund.
About a year and some ago we held an auction via FurAffinity (so keep in mind we both had accounts and knew the commissioner's username) and we were each given what the commissioner wanted drawn via personal PM from them, with the work split evenly.
Some time later, the commissioner let me know they were having a hard time contacting her. When I first heard about this I confronted Momo in front of our mutual friend and Momo pinned the lack of work on me not telling her what she needed to do or me not giving her the commissioner's contact information, despite the fact they had PM'd her multiple times. I contacted the commissioner myself, sent her the updated info on what they wanted drawn via skype, as well as gave the commissioner Momo's new username so they could contact each other and went on my way.
Once I had finished my half, the commissioner once again let me know they had not had any contact with her.
At that point I talked to Momo directly and asked her to please send them an update message and if she was in a bad way we could figure something out between the two of us or I'd take some of her work. She agreed.
After about 2/3 days not hearing from her still, I noticed she had been active on InkBunny. At this point the client had contacted again worried, so I told them if she continued to ignore us both, I would take charge of the work so they would not be left empty handed. When the next day they said they had still not heard anything back, I decided to post on her journal to get some sort of action out of her since she was clearly ignoring sending the client a message at this point.
It worked and she replied to them nearly instantly.
While I did not mind doing her half of the work, I hadn't expected to hear back from the commissioner themselves that I was now in charge of it instead of her.
(Again I DID NOT at all mind doing work for them! They has been nothing but patient and I appreciate that and am MORE than happy to get them their owed work rather than have them wait longer based on her response.)
I asked if they could forward their correspondence so when I asked for my half of the payment back from her I'd have records of their conversation and her handing the work over to me for paypal evidence if needed. I was more than a little shocked to see she had posted my 'worst case' scenario as option one, as well as that she HAD been able to pay rent up through July. Also, she had lied about not being online to the commissioner, as well as saying she didn't know what she was supposed to be drawing when I had told her via skype some time ago, as well as the commissioner PMing it to her.
I confronted her via skype, and at first was ignored once again.
So, I decided since she was online via her posting to her momochi blog to send her an invoice;
to which the next day she instantly replied, surprisingly aggressive:

She mentions a few things here I'd like to point out. One being not online, when in-fact she had been active and posting on her new tumblr, again actively ignoring us. Two, that she had to sell things and had had a hard time getting rent when in a June journal she says she's gotten very large new commissions that paid for full everything she needed. Lastly, at the time I messaged her on skype I was unaware of her huge backlog other than that of the auction work that wasn't done and the three new commissioner's large commissions.
The only thing I can agree with is that she obviously has lost interest, but if that were the case she should have informed me and the commissioner so we might have worked something out sooner.
I've sent her an invoice for the refund and given her a deadline, so hopefully she'll be able to comply. Other than spamming the reminder button, I am unsure if I can contact paypal directly about it? Any advice on what to do would be greatly appreciated. :)
On the 22nd of July she finally contacted me and spoke to me about an unrelated matter via skype, but no mention of where we stand on the invoice. She did however mention something about actually working on her backlog, but I've nothing to confirm this other than her word.
It's now August and I've sent another reminder on the invoice, though this time she's not been super active online.
She posted a journal on her accounts about moving house and getting all her dues owed up to by the 20th of August. I've sent her reminders as well as trying to contact, but nothing thus far and she's failed to live up to the due date she set.
I sent her a paypal notification many times, and it was only until I expressly stated in one that I'd be contacting paypal that she sent me a text message asking me to please not do so and she'd pay me back asap. I agreed.
Since then she's been active online, and messaged me via skype but nothing about the funds she owes me. She's account jumped again, but seems to have gone dark once more as people/her owed commissioners discovered her new account.
I sent a PM to her new account expressing my concerns, but despite her being occasionally online she's not replied. I've not heard from her in over a week as of 9/30/2013

11/13/2013 -This morning I received an email from paypal notifying me that the invoice for the refund she owed me had been paid, thus this transaction can be marked as resolved. :)
