WHAT: 2 Wig commissions valued at 55 per wig, $110 all up.


The file above explains the When, Proof and Explain very well. ^^' I hope this is okay. 

Side-note: I did not ask the deviants of Complaints forum to harass or point out Bunny's errors to her. I honestly did not expect them to pounce on her the way they have. Nonetheless, she continues to hide the comments, even marking them as spam, pretending as if nothing's happened.

You think so? While image reports are rare and unusual, I thought it was pretty easy to follow. Though I admit I would prefer people didn't do it this way in the future.

I didn't find this hard to follow myself, though I've certainly never seen a beware posted like this!

To me, you seemed very polite and professional in all your contact with her. You had every right to ask for a refund at that point and I find her TOS and behavior abysmal. Yikes, beware well warranted.

I'm glad I come off that way ^-^'' I was worried, other people seem to think I was pushy and selfish for hounding her. (their words, not mine >.<) But they /were/ her friends and fans, trying to defend her reputation.

This seems to me to be a clear case of an artist who can't separate the personal from the business and they bring their personal feelings into situations where they shouldn't be.

The reasoning that they can hold onto the money that was paid to them for goods which were not delivered if they find that their client is "trouble" shows an emotional response to something that they perceive rather than good business practice.

After the monetary breakdown of where the money went, I think the solution would have been to send the OP the wigs and both parties have done with it. If Rabbit Tales has bought the wigs then the wigs belong to the OP.

I am going to ignore the side projects on this. I have build a plush or a puppet in the middle of working on a commissioned piece to clear my head. However I keep a careful eye on my deadline(s) and make sure my clients know where things stand. WIP are important here.

Now the $110 question is, did she send you the things that she said she was going to send you?

She said she sent the unstyled wigs/extensions to my friend's house, it has been almost a week and my friend has not received them yet. I'm going to give it another week or so at least and if they don't arrive, well, poop, I'll have to contact her and ask what's up. *cringes* I don't know if she sent the dyeing supplies too - but I should think so, considering I paid for that too.

Honestly, you are *partly* at fault for not giving a deadline when you had a deadline in mind. Yes you were under the impression that it would go quickly, but the artist never promised that to you, so they were under no obligation to meet an invisible deadline they never knew existed. That is really entirely on your head.

But they are *massively* at fault for their horrible reaction to your request for a refund. They should have attempted to work things out, not lashed back and acted as though you were making some kind of personal attack on them.

I know I'm at fault for not giving a deadline but if I had known she had a waitlist or a queue at the beginning, I would have specified, heck, I should've specified when I /did/ find out she had one but I thought there was plenty of time and that she would focus a majority of her time on commissions ^^'' it's my mistake to assume!

I agree D: I was so shocked by her hostility! Admittedly, I forgot that her TOS stated no refunds, because it'd been 3 months since I'd read it so I kinda derped there xP But still, she should be able to answer a question sensible not angrily!

Uh, no. It is theft to take your money and not deliver something for your money. It isn't your fault that she doesn't know how to balance her costs and time it takes her to style the wig.

This was really easy to follow! I like how this beware was put together.

That being said, something stops being a hobby when you start taking money for it. You can't take money for a product and then tell someone to shove off when they want their product, that's theft.

Avoiding. Shame, I love their pony wigs and would've considered them for a Roseluck wig.

I think the "It's a hobby" stance is a horrible defense for her business, she isn't doing herself or her potential customers any favors by saying that! It'll just make them steer clear of her, specially when they read that she can deny service any time before and after payment >_<''

Personally, I love the way this beware was formatted. I vastly prefer something like this to *giant pile of links* followed by a long paragraph of explanation.

What this artist is doing is theft, plain and simple. You cannot just take someone's money and then never deliver their product, even if they were really nasty to you. OP was very nice and patient, and the artist was way out of line.

I think the only mistake OP made was not establishing a deadline. Even if it is 6 months to a year out, always make your deadline known.

Only because you dont put any deadlines dont mean she can just take her time forever I mean better be at least half done then not or...
I cant explain today >_<. And update now and then is nice and her TOS is just cruel and scares me. Her behavior, she either have/had a bad day or she need to maybe to learn of to treat customers and so on.
Hope she wont hold back your wigs.

So I guess next time, make a deadline or ask for how long it takes for finished product.

Its okay! And yeah, I always update my customers on how their commissions are going like, when I'm sketching, inking, colouring, etc. I never like the thought of leaving them in the dark!!

She's reacted the same way with others, she always seems very unapproachable and quick to defend herself. Like she made a Luna wig and the commissioner wanted it purple, instead of blue. When people prefered Luna's wig to be blue, she hissed at them that the commissioner wanted it purple. She even went as far as saying if anyone pointed out the colour difference or that they simply prefer blue Luna over purple Luna, she'll mark their comments as spam o_o'' its a bit harsh!! People are allowed to have opinions, but it seems anything that doesn't directly ass-kiss her oh-so-amazing work, she removes.

It reminds me of how I started out in drawing. I used to be very sensitive towards constructive critcism but I now know it's something I have to learn to deal with - positively! The fact she hasn't grasped that concept yet, I fear her business and her artistic ability will suffer badly.

I love how this was laid-out, it was super easy to follow and read!

I'm really sorry this happened to you, you seem like you'd be a pretty patient and understanding customer. It's s shame she thinks she can take people's money and not deliver anything to them. Theft is theft, and for some reason she seems to be okay with it.

Hope you eventually get some kind of compensation for the money you paid. Her work is lovely, but her ideas of how to run a business are downright awful.

I would love to get compensation but just receiving the wigs would be enough - I may not be able to achieve the commission design exactly but I should be able to use them for something else if possible ^-^;;

I would go the legal route but unfortunately, its not very cost-effective to do so. It's a pity because a lawsuit would be just the kind of wake-up call she'd need!

Is she even going to send you the unfinished wigs? This is appalling. You were a lot calmer than I would have reacted and I applaud you for that. I hope they do turn around and realize how terrible they are acting.. ugh. Beware well warranted. D:/

My friend hasn't recieved the wigs yet. I'm worried that she has not actually sent them at all - I'm hoping that's not the case!

Thank you! And I doubt she will realize her actions, she seems to care about money more than customer satisfaction.

Holy nasty TOS batman! That attitude is enough to make the Joker cry. The whole thing just smells rotten when there is more side projects completed than commissions. I'm sorry that you had to go through this sweetie.

Oh gosh, no kidding! I would feel absolutely awful and guilty if I chose to do things for myself when I know there's a queue of paying customers patiently waiting for their commissions to be completed!

Also, OP, if it helps you any, Google has a cached version of her ToS from August 20th, pre-edit, which you can nab a screenshot of for your records.

I'm sorry you had to deal with that attitude. I hope your friend gets everything and finds a technique that works amazingly well for dying them.

Thank you so much!! My friend still hasn't recieved the wigs - she's personally really upset about the whole thing, the fact I lost money and the lady's attitude towards the whole thing stank!

But you should have come up with a deadline. However, this artist's reaction toward your asking for a refund was awful. Beware well-warranted.

Someone please correct me if I'm wrong, but aren't TOSes not legally binding if they're protecting illegal activity? Even more so when[as far as I've seen] the client hasn't verbally agreed to it either?

Correct. A ToS does not trump the law.

Yeah if it wasn't ever agreed to, then it is not contractually binding whatsoever. Most people have a clause that you're agreeing to their ToS by default by commissioning them, but the ethics on this are debatable.
Also, clauses do not apply retroactively so if someone accepts a commission and changes their ToS later, the changes do not apply to clients who agreed to the older version.
