Commissioner beware: Kibble.

I've been avoiding making this a widely public issue, hoping that it could be taken care of privately. Alas, this does not look to be the case and it's high time to put this out there.

Eight months ago I completed a husky head for a fellow who goes by "Kibble" or "Kibblepup". The fursuit's name is Icey, and this is the head piece in question:



Ordinarily I take a non-refundable 30% deposit upfront on fursuit commissions with which to buy materials, but as Kibble provided me with the fur I waived the deposit to start and lowered the price of the head. I had the head complete for him within a few weeks and then he came to visit me and picked it up.

He owes me a total of $400 for my labor and the other materials I put into the head. I have yet to see a cent of this money, and I repeat, the head has been in the commissioner's possession for EIGHT MONTHS now.

I usually don't let items go into a commissioner's hands without having received full payment either, but at the time I considered this guy somewhat of a friend and thought I could trust him.

Lesson learned: never trust when business is involved.

I've been contacting him via email and IM since asking when he plans to start payment. I've offered to let him do it in increments as small as he can handle, even ten, twenty bucks at a time until the head is paid off. He keeps saying that he intends to get me "paid off soon" but never starts payment. Given the amount of time it's been, I'm rather afraid I'll never receive it. He's stopped responding to my emails as of late.

Wish he'd just pay for the damn thing, as was agreed upon, so I could just forget it and move on. I don't like having to chase down payment. It makes me feel uncomfortable and like a bully.

Any thoughts on what I can do at this point?


UPDATE: Apparently harassment generated by this post has gotten to Kibble already, because he has contacted me as a result and is making new promises to attempt to begin payment. I will edit this post again and let you know if he does indeed come through. Regarding FCN though: please do NOT do anything rash. Harassment was not my intention, I just wanted to be paid and get this settled. It would be inappropriate for anyone else to get involved. Thank you.

UPDATE #2: Kibble has indeed started payment on the suit now! He sent an initial payment and we are trying to work out a regular interval schedule for him to continue paying off the head. Thanks for the help and advice everyone. The mods can mark this as resolved for the time being.

Kibble has also mentioned people sending him threatening emails as a result of his initial failure to pay. If you're responsible for this, please stop. Again, I did not want to cause him any trouble, especially now that he's gotten back into contact willing to pay.

coming from a person that makes fursuits, you should have NEVER given him the head in the first place because he did not pay.

and also, he needs to give the head back if he cannot afford it.

$400 is ALOT of money... hell, that's reportable to the police.

my best bet? try to get it back. but be mature about it. because I read "and picked it up from me" I'm guessing they're local and therefore I would probably confront them in person.

Yeah, it was definitely a mistake to let him take it. =/

I'm originally from Ohio, he lives near the Ohio/Michigan border. It's a few hours drive and I don't know where he lives. He just used to visit me now and again.

I am however currently living in Germany and have no way to confront him in person.

How would you go about getting the police involved? Some folks have mentioned the notion of taking it to a small claims court, but would a few emails back and forth about details and concept art be enough proof to stand a chance?

Well, your learned your lesson, at least. NEVER EVER give things to a customer if they haven't paid for it.

Check with your state about small claims court. I think that would probably be your best bet if he refuses to pay.

Egh, no good advice, just sympathy :/

Would it count as harassment if people at conventions continuously stuck notes on his back, in the style of "kick me" notes, that say "HI, I'M A THIEVING WHORE WHO HASN'T PAID THE ARTIST WHO MADE THIS HEAD FOR ME :D"
I'm guessing yes ;P

But, could cons do anything? Like ban him from fursuit dances or parades just to send a signal? :/

Most conventions have some sort of policy against ever acting on personal disputes such as this. The only thing they could or would do, in most cases, would be to act if he did something AT the convention itself. e.g. stole something from the art show or didn't pay at someone's table (if there's proof). :/

Heck in one case I was actually griped at because I had the gall to complain to con staff that someone in the dealer's room was selling rip offs of my work. :( It really depends on who is on staff and how professional they are, I guess.

Me, I would address it as follows:

Email him and tell him that he was 7 days to pay 1/4 what is owed, and the remaining 3/4s must be paid over the next 3 months. Failure to pay this schedule will result in your taking him to SMALL CLAIMS COURT in YOUR city. You don't need lawyers in small claims court. And if he fails to appear for the proceedings, you win by default, and he will LEGALLY be required to pay up. If he fails to pay, then it is a CRIMINAL matter and his butt (along with the head) will be arrested for failure to obey a legal court order.

Tell him that if he has the money to go to conventions, then he has the money to pay for the fursuit he commissioned from you. DO NOT TAKE THE HEAD BACK as he clearly has funds. Tell him that you are perfectly within your rights after an entire year to consider him a deadbeat and that if he doesn't pay up during this last-chance offer, that you will begin legal proceedings against him as a deadbeat deserves.

As a result of stir generated by this post, he has now contacted me and promises to start payment shortly. I am hoping this will indeed be the case - I'll believe it when I see it.

Good to know about how small claims courts work though! I was wondering how it could be handled. Thanks for the advice!

Wow, why in the world would you let him have the head if he didn't pay for it? 8\ Seems like you already know that though, so I hope everything works out. Seconding the small claims court thing though.

I think you should edit the post about the section where you encourage people to walk up to him and person if they see him wearing the suit, especially if you mention at the bottom not to do it. Repo-ing a fursuit is quite an amusing concept, but this community shouldn't be used as a platform for harassment. I do hope you get your money all the same. That is an adorable head and I can tell it took a lot of effort and time to do

Well clearly you've realized your mistake. Luckily this post has scared him into contact. Don't let his cheap rear end get away with this. He either has to pay up or face you in court.

Man, friend or no, I never give commissioners the finished work until I see payment of some type.

Hope he actually follows through and pays you.

Kibble has gotten into contact with you, claiming he was 'harassed' by members of A_B over this? Is that what your update means?

If that's the case... I am a displeased mod.

Apparently so, he says people "have been emailing him threats" or something. o_O Definitely not my intention, although I guess it worked. It might be because he was involved in some pretty heavy drama earlier in the year and people already had him in their crosshairs, because I don't know how they would have gotten his contact information.

If that's true, I do hope they leave him alone. I just wanted this settled and paid, not to cause him difficulties.

Saw that head at FCN this weekend!

Sitting on a table just like two feet away from me while he walked around and chatted with people.
