Terms of Service Inquiry

With a recent post regarding a TOS, I would like to inquire to see if anyone would have any advice as to where to start building a TOS... What to include, what aspects are important, and what to avoid. (Templates?)

I think this could also be beneficial for others here, I can't be the only one wondering! It's much more to have a good TOS, than just a TOS.

I don't have an official TOS because most commission experiences of mine have been pretty smooth. I keep thinking about making one, and I probably should just in case.

What are your prices? How/when do you receive payment? Do you take installments?

Also The actual process itself to let people know when they'll see updates and what to expect.

What behaviors you do not approve of in commissioners... what content/rating you'll do.

And... probably a lot of other stuff would be useful. X3

I had a few friends help me go over it and tried to address as much, while keeping it short/easy to read & understand as possible. May have some holes tho, ya never know :/

i say make it short and sweet, and try not to sound to spiky

Here's mine for reference.

Some things to include:

- Content guidelines, if there are things you just won't draw or things you are uncomfortable drawing. It's handy to include a reminder that you can reject any commission request for any reason, you don't have to take it just because they ask.
- Prices and payment (how much is due and when, what kind of payment you accept, etc.)
- Outline of the commission process (sketch, progress photos, approval stages, etc.)
- Refund policies (do you offer them, and under what specific circumstances)
- Termination/cancellation policies (ALWAYS handy to include a clause that will allow you to cancel for any reason as a catch-all)
- Timeline or deadlines, and what happens if either party misses them
- Copyright/ownership. Who owns the finished piece and what they are allowed/not allowed to do with it.
- Revisions and edits. How many do you allow, at what stages, and how much is too much.
- Shipping (prices, policies, deadlines for shipping, insurance options, shipping methods - USPS, UPS, FEDEX, etc.)
- Your contact information and guidelines (do you only want to be contacted via email? IM? PM?)

Just some ideas. Look at others to get other ideas, heh.

Hmm, would it be alright with you if I used your TOS, with some changes, since I do work a little different? Yours is much simplier to read them mine XD

Sure thing!

Just make sure you remember to change at LEAST contact information to your own, and read through it thoroughly to change any policies that don't apply to you personally.

Beyond that, have at it. I've got no problem if you want to copy or use my TOS as a base to get yours written up. I'm glad you find it helpful. :)

Oh of course lol Just a lot of thigns on there I either haven't thought of, or, on my version it's too detailed and complicatd. There's a few things needing to be changed and contact info etc. ^^Thankies for letting me use it!
