General Beware

I'm not going to name the person but this was a big red flag for me and thought I'd bring this up just in case it happens to someone else.

This person asked me if i would do a commission for them, but they wanted to use a private character in which they requested i give them the PSD upon completion and delete the file from my own computer. (Essentially giving them rights to my image and pretending i never made it. >. >)

I told the person flat out that this was a big red flag. They stated they understood and that they were just protective of their private character. (Not wanting to get stolen i guess.) I offered other options i have in my TOS in regards to commissions i'm not allowed to post and they said possibly they would do that but for now use a regular character. A little more suspicious here as well. I'm not entirely sure i wish to continue buisness with this person but they aren't ordering from me right now as I'm not open for commissions so we'll see in the future.

Just wanted to warn others who may come across this scenario in the future and possibly get some opinions on how someone would handle this situation in case OTHERS aren't sure how to so no one gets pulled into a likely trap.

If enough people want screencaps (i will be taking out the persons name) i will post them up but otherwise its just a scenario.

Advertising advice?

This is my first post here, and I do not have caps right now, but I can get them when I get back home if they are indeed needed.

This isn't a beware, but I would like some advice in a situation and I feel this community is the best place to go.

I was contacted by someone (I'll withhold the name for now) over the span of 2009 for five separate commissioned drawings. I had known him previously from a toy forum we mutually use. These said commissions were technically trades - they were 'paid' for in toys of equivalent value. (He runs a website that sells these toys and was using the forum to gain business and clients)
I finished all five of the drawings and mailed them to this person and in return received my toys no problems.

A short time after this, he mailed me a t-shirt with one of my drawings on it advertising his website. I was angry because he had edited my drawing. Originally, the drawing was of myself hugging a tyrannosaurus. Since it was a self portrait, I had drawn a tattoo I have on my arm on my illustrated self. For the shirt, he erased the tattoo and somewhat sloppily added a line on the back of the arm that made it appear the arm started further up the shoulder. He used a brown colour for his added line as opposed to the black colour I'd used in my original drawing. I said nothing, at this time, because I did not want confrontation.

However in December 2010 he contacted me again, asking if he could use the very same drawing that he used on this shirt, but instead in an advertisement. He hadn't asked to use it on the shirt so I saw this as a good sign - so I said sure, just so long as he did not make any major edits without my permission, and if he did want an edit to please let me do it myself. He obliged, I erased that tattoo on the arm myself. The advertisement was published in a magazine this month advertising his website.

Since then I've had family and friends reprimanding me for letting him use my artwork without some sort of fee, or without buying the rights to the drawing.

He emailed me again last night saying he wanted to use another of the drawings he commissioned for another advertisement in the next issue of this magazine.

My question is this: He did not buy these drawings technically, he traded for them. Also he did not buy the rights to them - should I be charging him a fee for using my drawings in the ads for his website? What would be a reasonable fee to charge? The magazine is published four times a year, and he doesn't appear to be selling the shirts by themselves but I do believe he sends them with an order if the order reaches above a certain cost. I would also like to note that I am credited as the "Graphic Artist" on his "About Us" page on his website, with a link to my own website.

I don't know where to begin with this, I'm really hoping all of you in this community can hand me some advice! I would really appreciate it very much.

If there are any details that need clearing up at all, please let me know and I'll do my best! And again, if caps are wanted please let me know. Any caps from 2009 are long gone however, since I did not archive them in my Gmail account and we never spoke via instant messenger. If anyone needs to know the name of the forum, the magazine, or his name and website I'll edit this entry, but if I could I hope to keep this only about the situation I need advice on, and not about who the situation entails.

I had to give this a long think before deciding to post here. A friend suggested I should, so here goes:

Nearly 3 years ago, I commissioned http://www.furaffinity.net/user/tinyfoxtaur aka http://www.furaffinity.net/user/gafoxtaur for an expensive commission. I've since paid it in full; a total of $500 for a 4-page comic. He has since finished the linework. Since then, trying to reach him is like pulling teeth. He has yet to finish coloring my commission. The few times I was fortunate to finally chat with him on YIM, he seemed very apologetic and kept promising me to finish it. Since then, nothing.

I understand my friend and others are in the same boat, waiting for him to finish their art. I don't know if his schedule prevents him from finishing his obligations, but come on! Three years for mine? I'm not asking for my money back, I just want him to finish what he promised.

 Alright, so this guy named Fluffdance, decided to commission me. He had commissioned me before, and I did them, and he was pleased. So, he commissioned me again like a month ago, for two sketches. I started work on them, and told him, and we kept in contact. I was trying to change my art up a bit so I was being slow, admittedly, but it wasn't nothing terrible as it had just been a little while since he payed. 

All of a sudden, he finds out that I have had commission problems in the past, which I have worked on, and refunded, and now I get things done; and decides oh , I must be a terrible person even though were were friends before! So he freaks out, and proceeds to post a journal about it. 



He had blocked me, so I used a different account to try to contact him, because I had to sort this out. He ignores me for a good while, until a few of my friends start commenting about him, then he tells them that he was talking with me, and them talking to him is just making things worse for me. So I note him again, and he FINALLY replies, and tosses things at me that he makes up. 

How apparently I kept ignoring him when he tried to contact me about his commission status; which is a lie, he never asked me during the time he says he did.


If AIM really messed up like he keeps telling ME (no one else for that matter, simply that I ignored him), he could have just noted me, but nope. I meet all of his stories with the truth, and since he finds out he can't make anything else up, he just ignores me again, and goes back to what he was doing.

When I see him freaking out at first, I'm just like, ugh, whatever, because he said I should just finish the art, so I did. I told him; yet he proceeded to continue to make up things and yell at my friends who just wanted to sort this out. He ignored me finishing things, AND making him a gift. So; I take down the commissions, and just refund him. But then he uploads the pictures I did to his account, acting like nothing happened, keeps replying to my friends with fake stories, and then a bit later, deletes his journal. So I was like. Uh, what? 

I try noting him again, while he continues to block my accounts, and my friends', and he tells me if I keep trying to talk to him, he'll report me for harassment. Which I know isn't a worry, since I talked to Dragoneer about it, and since my friends sent in trouble tickets about the stolen art, Dragoneer removed the images. 

Then, Fluffdance posts a journal about that too, right after the images are removed, posting them on ANOTHER site, so he can keep posting them around, I guess it's a loophole;


At this point he still has my money, even though I don't want to be refunded, he keeps saying he will, and blocks me every time I try to contact him. Continuing to drag this out, and posting the images around, when he doesn't have the right to. 

So yeah. Watch out for this guy. Apparently he does things like this a lot.
