WHERE: Gmail and Discord

WHAT: Full Cel Shaded digital coloured pic of an OC with “enormous breasts”. It was a 60$ USD commission.

WHEN: First idea sent on March 24th, denied on April 1st. Second idea sent, accepted and paid on April 4th.


On March 24th I’ve asked Zdemian for a commission. He asked me to put the details of it in an e-mail to send it to his Gmail address.

He denied the first NSFW idea I sent him on April 1st, so I gave him another NSFW idea on April 4th via Gmail too. He liked it and accepted it, sending me the Invoice, paying him at the very moment on the same day. He was going to start the pic the moment he got paid.

The idea was to draw my OC Vernan in NSFW content, in a hotspring, relaxing and humming out, having enormous breasts with a little plastic duck at the neck side.

After that, I’ve been trying to contact him every few days later via Discord to see if he was doing the commission. The money was sent but the invoice disappeard from the Paypal list, though I could do a screenshot of the e-mail or money sending before all of this happened. I don’t understand what might’ve happened.

I’ve contacted him again via Discord more until he replied on Tuesday 9th of October (That’s 6 months later!), saying he didn’t wanted to do it, not even wanting/having the intention to reply to me.

There’s nothing more after this

This unfortunately appears to be due to a major language barrier, but your messages to him refer to "a request for a commission" which describes, literally, a request for a commission - a message proposing an idea (like your first exchange with him) which is not the situation you're in now. He accepted your second request, and accepted payment, therefore it's not a request but rather a commission that has already been paid for - paid being the key word you need to use here.

It's not your fault, because he should have been keeping track of his commissions and not put the responsibility on the commissioner to hassle him. But his messages indicate to me that he has forgotten (and never made note anywhere) that he accepted your second request, told you to send payment, and has received that payment. That is wildly unprofessional of him but his uncaring responses are probably because he thinks you are prodding him repeatedly to look at your commission request (in which money would not have yet been exchanged). That's most likely why he belittled the importance of responding to you.

You should send him the screenshot of his e-mail reply where he accepted the second idea and told you to send $60 to his PayPal, and also send him the screenshot of the PayPal receipt, so that he can see his own words of acceptance and the proof that he has your money. In that message, I suggest you also say something similar to the following:

"Please check your records. You did respond to me, by accepting my second commission idea and asking me to send $60 to your PayPal, which I did on April 4th (see attached screenshots). You have had my money all this time as I have waited patiently for updates on my commission. I request that you complete the commission as we have agreed or refund the $60 back to my PayPal in a timely manner."

If you don't want the commission anymore but instead just want a refund, remove the part asking him to complete it, and give a reasonable deadline that you would like to see the refund be in your account by (perhaps a month?). If he gives you trouble, or ignores you, it might be an idea to contact PayPal or your bank/credit card company to try to recover your funds forcibly - though others here in this community may be able to provide better advice regarding PayPal's policies here, I've not kept up with the changes in recent years.

First of all, and sorry for being late to tell you this, is that the 1st paypal account, wich was used to send the 60$ to the artist, got banned due to issues that are not related to this commission issue.
I've contacted the user and wrote him the message you suggested me with a few changes due to the decision of wanting a refund. The user acted a bit hard and shown me the following screenshots

However, there's something that doesn't feels right.. The e-mail i sent him from April 4th is nowhere to be found in his inbox screenshot. It skips from April 3rd to April 19th (Check also the scroll bar at the right side. Even if it's multiple screenshots joined or anything, it's been cutted out -right on that very specific date spot- . There's a chance that he must have deleted the e-mail in order to prevent the report to work out or simply hide it so it doesn't gets shown incase i was going to report it here.. But as you saw, i sent one on April 4th regarding the 2nd idea i asked him, and you also saw that he sent me an e-mail on April 4th accepting it.

Not only that, but on the Paypal screenshot from his side shows only the 1st commission i asked from 2017..However, the payment i sent of 60$ was done in this year 2018 on April, yet the results shown are from 2017. There's one thing to notice though. His "paypal ID search" search icon area shows ONE NUMBER CHANGED at the end of the search engine, wich ends in 9990M , while my April 4th ID ends in 9993M , a 3 changed to a 0. I don't know if an user is linked to an ID or not, or just the invoice..

Besides that he spoke on the DC server a few moments ago.

The user seems to be evading any possible way to refund me the 60$ and is trying to delete all the evidence beforehand so that he wins and i lose.

What can i do now?

His attitude is really atrocious - the way that he seems to feel entitled to keep your money because he feels bothered by you is appalling. It would have been really easy for him to just delete the e-mail, as you said, so I'm not sure why people would believe him based upon that screenshot. It's a real shame that he's smearing you to others with falsehoods.

You could try calling your bank and/or CC company that was associated with the banned PayPal account and explaining the basics of the issue to see if they would be willing to help you issue a chargeback. Otherwise, you've done the right thing by writing an AB post and informing the community. Unless you're willing to go to small claims court which is probably impossible if you live in different countries and would cost more than the commission anyway, there's not much more to be done sadly as he clearly has no intention of holding up his end of the transaction. Hopefully others will see this post and will think twice before commissioning him though.

Out of curiosity, are there any art accounts tied to this artist? Knowing their DA/FA/etc or wherever else they may have linked you examples from might be a way of seeing if anyone else has had similar problems with them in the past; it'd be nice to know where to watch out for them too, since Discord names can be changed so often.

REALLY put off by the artist's tone. Maybe this is a big misunderstanding and they legitimately have forgotten all about taking your money/have also somehow misplaced the payment and emails, but that seems like a stretch-- and even so, they do seem really rude about the whole thing. Even if they thought you WERE just pestering them, it was still asking about a paid commission and you're a previous client of theirs. A little professionalism in terms of response would go a long way.
